Legal Agreement
These Terms and Conditions constitute a legally binding agreement between you and Apertura Photography Education. By accessing our website, enrolling in our courses, or using our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these terms.
This agreement supplements and works in conjunction with our Terms of Service and Privacy Policy. If you do not agree to these terms, you must discontinue use of our services immediately.
User Responsibilities and Conduct
1. Compliance with Laws and Regulations
You agree to:
- • Comply with all applicable local, national, and international laws when using our services
- • Respect copyright and intellectual property laws when creating and sharing photographic work
- • Obtain necessary permissions when photographing people or private property
- • Follow all safety regulations during practical photography sessions
- • Adhere to Japanese laws governing education and consumer protection
2. Prohibited Activities and Behaviors
The following activities are strictly prohibited:
- • Using our services to create, distribute, or promote illegal or harmful content
- • Recording or photographing other students without their explicit consent
- • Disrupting classes or interfering with other students' learning experience
- • Making false claims about your credentials or photography experience
- • Attempting to resell course access or materials to third parties
- • Using course knowledge or materials for commercial purposes without authorization
3. Content Guidelines and Restrictions
When sharing photographs or content during courses, you must ensure all work is appropriate for an educational setting, does not contain offensive, discriminatory, or explicit material, respects the privacy and dignity of subjects, does not infringe on others' intellectual property rights, and does not promote illegal activities or violate public safety concerns. Apertura reserves the right to remove any content that violates these guidelines.
4. Age Restrictions and Requirements
All participants must be at least 18 years of age or older. If you are under 18 and wish to participate, you must have written parental or guardian consent and supervision. We reserve the right to verify age and require identification if there are concerns about age eligibility. Minors participating with parental consent must be accompanied by their parent or guardian during all course sessions.
Legal Responsibilities
5. Indemnification Obligations
You agree to indemnify, defend, and hold harmless Apertura Photography Education, its instructors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these terms, infringement of any third-party rights, or any negligent or wrongful conduct on your part. This indemnification survives termination of your relationship with Apertura.
6. Privacy and Data Protection Compliance
You acknowledge that we collect and process personal data as described in our Privacy Policy. You consent to such collection and processing and agree to provide accurate information. You are responsible for maintaining the confidentiality of your account information and for all activities under your account. You must notify us immediately of any unauthorized use or security breach.
7. Third-Party Interactions
Our services may include links to third-party websites, references to third-party products, or opportunities to interact with other students and instructors. Apertura is not responsible for the content, accuracy, or practices of third-party sites or the conduct of third parties. Any transactions or interactions you have with third parties are solely between you and them. You acknowledge that we disclaim all liability for third-party content and interactions.
8. Equipment and Safety Responsibilities
You are responsible for providing, maintaining, and properly using your own photography equipment during courses. Apertura is not liable for damage to, loss of, or theft of your equipment. You must exercise reasonable care during practical sessions and follow all safety instructions provided by instructors. You participate in outdoor photography sessions at your own risk and must maintain appropriate insurance coverage.
Disclaimers and Liability Limitations
9. Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Apertura disclaims all warranties, including but not limited to:
- • Implied warranties of merchantability and fitness for a particular purpose
- • Warranties that our services will meet your specific requirements or expectations
- • Warranties of uninterrupted, error-free, or secure service delivery
- • Warranties regarding the accuracy or completeness of course content
- • Guarantees of specific skill acquisition or professional outcomes
10. Limitation of Liability
To the maximum extent permitted by Japanese law, Apertura Photography Education shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, opportunities, or goodwill, arising from your use of or inability to use our services. Our total liability to you for any claims arising from these terms or your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.
11. Consequential Damages Exclusion
Under no circumstances shall Apertura be liable for any lost business opportunities, damage to professional reputation, failure to achieve career objectives, or any other consequential damages arising from your participation in our courses. Our educational services are designed to provide knowledge and skills, but we make no guarantees regarding career advancement, income generation, or professional success.
12. Force Majeure Provisions
Apertura shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, labor disputes, technical failures, or other force majeure events. In such cases, we will make reasonable efforts to reschedule courses or provide alternative arrangements.
Legal Framework and Dispute Resolution
13. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Osaka, Japan. By using our services, you consent to the personal jurisdiction of these courts.
14. Dispute Resolution Procedures
In the event of any dispute, controversy, or claim arising from these terms, the parties agree to first attempt resolution through good faith negotiation. If negotiation fails within 30 days, the parties may pursue mediation before a mutually agreed mediator in Osaka. Only after exhausting these alternative dispute resolution methods may either party pursue litigation. This clause does not prevent either party from seeking urgent injunctive relief when necessary.
15. Severability Clause
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these terms. The remaining provisions shall continue in full force and effect.
16. Terms Modification Policy
We reserve the right to modify these Terms and Conditions at any time by posting updated terms on our website. Material changes will be communicated to enrolled students via email at least 14 days before they take effect. Your continued use of our services after changes become effective constitutes acceptance of the modified terms. If you do not agree with the changes, you must discontinue use of our services.
17. Entire Agreement
These Terms and Conditions, together with our Terms of Service, Privacy Policy, and Cookie Policy, constitute the entire agreement between you and Apertura Photography Education regarding your use of our services. These terms supersede all prior or contemporaneous communications, whether electronic, oral, or written, regarding the subject matter herein.
18. Assignment and Transfer
You may not assign, transfer, or sublicense your rights or obligations under these terms without our prior written consent. Apertura may assign or transfer our rights and obligations under these terms to any successor entity in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this provision is void.

By using our website or enrolling in our courses, you acknowledge that you have read these Terms and Conditions in their entirety, understand your rights and obligations, agree to be bound by all provisions contained herein, and recognize that violation of these terms may result in termination of services and potential legal action. You further acknowledge that you have had the opportunity to seek independent legal advice regarding these terms if desired.
